Not that I condone such conduct, but the prosecutors are abusing the laws in question with these charges.

Both [Mom and boyfriend] face charges of child neglect, criminal recklessness with a deadly weapon and allowing a child to possess a firearm. 

Pshaw.

Of course, I assume the gun was not loaded, in evidence of which I cite the fact that this Guardian story is totally silent on the question.

Had the gun been loaded they would not have omitted to report it.
