His originalism is such ballocks.

Sure, the constitution does not forbid every form of political insanity.

Not even some of the forms struck down from US law in its name.

But I'm pretty sure it does forbid these.

And I think some court cases have (mistakenly relying on incorporation, which Scalia actually accepts) struck these down.

In at least seven U.S. states, constitutional provisions are in place that bar atheists from public office and one state, Arkansas, has a law that bars an atheist from testifying as a witness at a trial, the report said.
