Congress has refused to provide an AUMF for ISIS and the continuing validity and relevance of the originals against al-Qaeda and its supporters and against Iraq are doubtful.

Have these 107 remaining prisoners ever been tried?
I gather not.
If they are POWs, unlawful combatants or otherwise, we are surely not now legally in a state of war with whomever they fought for.
They must be released or tried in real and legitimate courts and released unless convicted of some war crime or other crime.
If they are not POWs they are and have been all along held unconstitutionally if they have not been tried and convicted.
The threat of recidivism is no excuse for refusing to deal with them according to law.
Gitmo is just another proof that neither of our major parties cares a fig for the constitution.
Since 9/11 the Republicans and the entire conservative punditry have been especially awful about all this.
But there is and has been plenty of blame to go around.
